摘要/Abstract

摘要：

由于责任保险的诉讼与和解过程牵扯到多方当事人的利益，本文通过不完全信息博弈方法研究原告雇佣律师在责任保险诉讼与和解过程中的信号作用，利用动态博弈树的方法研究律师在不同收费制度下的行为动机，分析两种不同收费制度分离均衡的存在性，并比较胜诉收费制与计时收费制的优劣。

Abstract:

Because of the liability insurance litigation and reconciliation process involving the interests of the parties, based on the incomplete information game method, the paper studies the signaling role of liability insurance in the process of litigation and reconciliation; then by use of the method of dynamic game tree, it studies the behavior motivation under different lawyer charging systems, and analyzes the existence of two kinds of different charging system separation equilibrium; at last, it compares the pros and cons about the contingency fee system and the hourly fee system.
