风险社会视角下我国构建大规模侵权事件社会分摊赔偿制度研究

摘要： 科技发展为人类人为地制造了更多的风险与威胁，人类社会步入了“风险社会”的特定时期。风险社会中因科学技术的发展而相应大规模侵权事件不断出现，使其救济赔偿问题成为时代课题。由于大规模侵权事件中受害者数量巨大、因果关系前后界定难、后果计量繁杂等特点，使得大规模侵权事件损害赔偿的难度加大；同时，司法诉讼、责任保险、行政救济的局限，及过分依赖政府完全介入等问题的叠加，使得大规模侵权事件事后救济陷入困境。借鉴域外经验，建立大规模侵权事件社会分摊赔偿制度是有效破解之道。

Abstract: The development of science and technology has created more risks and threats for human beings, and human society has entered a special period of “risk society”. With the development of science and technology, large-scale infringement incidents are constantly appearing in the risky society, which makes the issue of relief and compensation become a topic of the times.Because of the huge number of victims in large-scale infringement, the difficulty of defining causality before and after, and the complexity of measuring consequences, it is more difficult to compensate for damages in large-scale infringement; at the same time, the limitations of judicial litigation, liability insurance, administrative relief, and excessive reliance on the full involvement of the government, make the relief of large-scale infringement into a dilemma.Drawing lessons from foreign experience, it is an effective way to establish a social compensation system for large-scale infringement.
